Our system of no-fault Accident Benefits here in Ontario is one of the most generous systems in Canada.

To help you benefit the most from this system, we maintain a department dedicated to overseeing Accident Benefits files on behalf of our clients.

We will assist our clients with the completion of originating forms, in communicating with their Accident Benefit insurer, in the submission of expenses, and in obtaining the appropriate medical rebuttal reports. This level of service can benefit you should the insurer take an unreasonable position with respect to the payment of a benefit.

If you were not at fault for the injuries sustained in your motor vehicle accident, then you may have both a tort action (lawsuit) and an Accident Benefits claim. At Hillier & Hillier, we will coordinate both your tort action and Accident Benefits claim to ensure that you receive full compensation.

Unlike many law firms and firms offering purely paralegal services, Hillier & Hillier does not charge or take fees from the weekly and monthly benefits that may be paid to our clients, such as monthly attendant care benefits or weekly income replacement, housekeeping or non-earner benefits. We will typically only charge a fee if we are able to negotiate a full and final settlement of an Accident Benefits claim on our client's behalf or if we are required to resolve a dispute over payment of a benefit.

Such disputes can be dealt with through direct negotiation with the insurer but will often require mediation and or arbitration at the Financial Services Commission of Ontario (FSCO).
