Dispute Resolution

If a dispute arises between you and your insurer, it must first be referred to the Financial Services Commission of Ontario (FSCO) by way of an application for mediation. Mediation is a non-binding process in which a government mediator will try and bridge the gap between the respective positions of the parties in the hope that settlement of the dispute can successfully be negotiated. Mediation is a mandatory process under the Insurance Act. Following failed mediation, a claimant can either go to court or apply for arbitration (a binding process unlike a mediation but which is less formal than going to court) at FSCO.
